B2B Exemptions in DNC Lists
We understand the importance of respecting an individual’s privacy and preferences when it comes to receiving communications from us or our customers. Recently, Lusha has received questions regarding whether our company needs to scrub against various countries’ Do Not Call lists. In order to help our customers understand the requirements, we have compiled a list of countries whose Do Not Call lists create business exemptions.
Australia
The Australian Do Not Call Register (ADNCR) specifies that business numbers are excluded from registration. Additionally, a mobile number does not qualify for registration if it is predominantly used for business purposes. It is not obligatory to cross-reference the ADNCR for B2B calls, as the ADNCR applies specifically to unsolicited telemarketing calls to individuals. Furthermore, if the call is purely recruitment-related, such as offering a job opportunity, it is generally not classified as a telemarketing call, and therefore, checking the ADNCR is not required.
Canada
Canada’s National Do Not Call List Rules create an exemption for telemarketing communications to a business consumer. It is also clarified that the rules do not apply to telemarketing calls made to a personal phone number that is also used for business purposes.
France
The French Bloctel list applies only to consumers, which the Consumer Code defines as people who act for non-commercial purposes.
Germany
Germany’s Robinson List makes it clear that commercial consumers and businesses cannot register their numbers on the list. Moreover, the Robinson List website states that scrubbing against the “Do Not Call” list is voluntary in Germany.
New Zealand
New Zealand’s Do Not Call registry is run by their Marketing Association. The Marketing Association website states that the service does not extend to businesses. Only members of the Marketing Association are able to use the list, and there is no requirement for businesses to become members.
Portugal
Portugal’s consumer rights regulations only apply to consumer relationships, which are defined as situations intended to promote the supply of goods or services or the transfer of rights between an individual (private person) and a professional. Such as purchasing a sofa for the home or getting your car repaired. It does not apply to purchases and sales carried out between two professionals.
Singapore
The Personal Data Protection Commission (PDPC) in Singapore maintains the country’s Do Not Call registry. The PDPC clarifies that the registry does not apply to business-to-business (B2B) marketing messages. Further, business numbers used for both personal and business purposes may receive B2B marketing messages.
United Kingdom
The UK’s Telephone Preference Service (TPS) and Corporate Telephone Preference Service (CTPS) allow individuals and businesses to opt out of receiving unsolicited sales and marketing calls. TPS is for consumers, while CTPS is designed for businesses. Lusha scrubs its phone numbers against both of these lists.
United States
The United States’ National Do Not Call Registry only applies to personal calls and does not apply to business lines or business-to-business calls. However, Lusha provides the service of scrubbing US phone numbers against the National DNC list.
